TERMS & CONDITIONS

These Terms and Conditions of Services (“Terms”) govern the provision of goods and services by Monaco Blue (“Supplier,” “we,” “our,” or “us”) to our customers (“Customer,” “you,” or “your”). By placing an order or using our services, you agree to be bound by these Terms.

1. DEFINITIONS

1.1 “Goods” refers to the building materials supplied by Monaco Blue.
1.2 “Services” refers to any ancillary services provided by Monaco Blue, including but not limited to delivery, consultation, and installation support.
1.3 “Order” refers to a request made by the Customer for Goods and/or Services.
1.4 “Agreement” refers to the contract formed between Monaco Blue and the Customer upon acceptance of an Order.

2. ORDERS AND ACCEPTANCE

2.1 All Orders are subject to acceptance by Monaco Blue. Monaco Blue reserves the right to refuse or cancel any Order at its discretion.
2.2 An Order is deemed accepted when Monaco Blue issues a confirmation in writing or proceeds with fulfillment.
2.3 Once an Order is accepted, modifications or cancellations require Monaco Blue’s written consent and may be subject to additional charges.

3. PRICING AND PAYMENT

3.1 Prices for Goods and Services are as listed in Monaco Blue’s official pricing document or as agreed upon in writing.
3.2 Prices are exclusive of taxes, shipping, handling, and other applicable fees unless otherwise stated.
3.3 Payment terms are as specified in the invoice or as separately agreed in writing. Late payments will incur interest at 2 % per week.
3.4 Monaco Blue reserves the right to adjust prices due to changes in material costs, market conditions, or errors in pricing.

4. DELIVERY AND RISK OF LOSS

4.1 Delivery dates are estimates only and not guaranteed. Monaco Blue shall not be liable for delays due to unforeseen circumstances.
4.2 Risk of loss passes to the Customer upon delivery of Goods to the designated location or carrier.
4.3 The Customer is responsible for inspecting Goods upon delivery and reporting any defects or shortages within 15 days.

5. RETURNS AND REFUNDS

5.1 The cancellation fee depends on the production progress, no refunds allowed after shipment.
5.2 Report any damage or error within 15 days of delivery via email to info@monacoblue.ca
5.3 Freight costs are non-refundable. If the item is unshipped, a 2% fee is charged
5.4 Return Merchandise Authorization (RMA) form should be completed and submitted for the return request process.
5.5 Returns are accepted only with prior approval from Monaco Blue and must be made within 30 days of delivery.
5.6 Goods must be returned in original, unused condition. Restocking fees of 35% may apply.
5.7 Refunds or replacements will be processed after inspection and approval of the returned Goods.

6. WARRANTIES AND LIABILITY

6.1 Monaco Blue warrants that the Goods will conform to the agreed specifications at the time of delivery.
6.2 Except as expressly provided, Monaco Blue disclaims all other warranties, express or implied, including merchantability and fitness for a particular purpose.
6.3 Monaco Blue’s liability is limited to the replacement or refund of defective Goods. In no event shall Monaco Blue be liable for indirect, incidental, or consequential damages.

7. FORCE MAJEURE

7.1 Monaco Blue is not liable for any failure or delay in performance due to events beyond its control, including but not limited to natural disasters, labor disputes, supply chain disruptions, or government actions.

8. INDEMNIFICATION

8.1 The Customer agrees to indemnify and hold Monaco Blue harmless from any claims, damages, or liabilities arising from misuse of the Goods or breach of these Terms.

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1 These Terms shall be governed by and construed in accordance with the laws of Alberta, Canada.
9.2 Any disputes shall first be attempted to be resolved amicably. If unresolved, disputes shall be settled through arbitration in Alberta, Canada except where prohibited by law.

10. GENERAL PROVISIONS

10.1 These Terms constitute the entire Agreement between Monaco Blue and the Customer.
10.2 No waiver or modification of these Terms shall be valid unless made in writing and signed by both parties.
10.3 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
